Loan Safety Guide – Protect Yourself from Loan Scams
Digital lenders promise quick cash, but many are illegal or predatory. This guide helps you spot fake loan apps and recovery agents, know your rights (RBI prohibits harassment calls), and outlines exactly what to do if you fall victim. By acting fast and following these steps, you can avoid financial traps and stop fraud in its tracks.
The Scale of the Problem
The RBI has warned repeatedly about illegal digital lending apps. These apps:
- Are not registered with RBI or any financial regulator
- Charge interest rates of 50%–500% per annum
- Use harassment and blackmail to recover money
- Access your entire contact list and photo gallery to threaten you
- Have caused dozens of suicides across India
Red Flags — Signs of a Fake or Illegal Loan App
Before downloading:
- App is NOT available on the official Google Play Store or Apple App Store
- App has very few reviews or very recent, suspicious 5-star reviews
- No mention of RBI registration number on the app or website
- Company address is vague, non-existent, or a residential address
During the loan process:
- Loan approved in minutes with no credit check or verification
- App requests permission for contacts, photos, camera, microphone — far beyond what a lender needs
- Interest rate and fees not disclosed clearly before disbursement
- You are asked to pay a processing fee upfront before getting money
- No loan agreement provided
- Loan is disbursed from a personal bank account, not a company account
After disbursement:
- Recovery agents call you before 8 AM or after 7 PM
- They call or message your family, friends, and employer
- They threaten to send morphed photos to your contacts
- They demand repayment of amounts far exceeding what was agreed
Your Rights Under RBI Digital Lending Guidelines (2022)
The RBI's Digital Lending Guidelines (August 2022) give you these rights:
- Key Fact Statement (KFS): Every lender MUST give you a one-page document showing exact interest rate, all fees, and total repayment before disbursement
- No app permissions beyond necessity: Lenders cannot force you to give access to your contacts, photos, or microphone
- Cooling-off period: You can cancel a digital loan within a specified period after disbursement (check your KFS)
- Regulated Recovery: Recovery agents must follow the IBA Code of Conduct
- Grievance Officer: Every lender must have a named grievance officer — find their contact on the app or website
What Recovery Agents Are PROHIBITED from Doing
Under RBI Circular on Fair Practices Code and BPSS guidelines:
- Calling you before 8 AM or after 7 PM
- Using abusive, threatening, or obscene language
- Contacting your family, friends, or employer without your written consent
- Visiting your home or office without advance notice
- Making false threats of legal action they cannot take
- Sharing your personal information (photos, contacts) with third parties
- Using AI-generated or morphed images to harass you
All of the above are criminal offenses. You can file FIR under:
- Section 384 IPC (Extortion)
- Section 499/500 IPC (Defamation)
- Section 66E IT Act (Privacy violation)
- Section 67 IT Act (Obscene material transmission)
Verify Before You Borrow — RBI Registered Lenders
Before taking any digital loan, check:
- RBI Registered NBFC list: rbi.org.in → Sitemap → NBFC → List of NBFCs
- The lending app must display its NBFC partner's name and registration number
- Search the company name on MCA (mca.gov.in) — should have a valid CIN
Safe digital lenders include those backed by well-known banks or NBFCs: MoneyTap (RBL), KreditBee (Kreditbee Financial), CASHe, etc.
If You Are a Victim — Immediate Steps
Within the First Hour
- Screenshot everything — loan agreement, messages, call logs, names of agents
- Do NOT pay further if you are being harassed beyond the actual loan amount
- Block the app from accessing your contacts immediately (Settings → Apps → Permissions)
- Warn your contacts proactively — a WhatsApp message saying "I may receive abusive messages from unknown numbers, please ignore" can limit damage
